This document, Terms of Service (”Terms”) outlines a binding contract between Pairly Climate Inc. (”we”, “our”, “Pairly”) and our users (”you”, “your”, “user”) — anyone utilizing Pairly “Services”, which include but are not limited to (1) our one-time click button at checkout (”button”), (2) our web platform at pairly.me (”platform”, “website”), and (3) our API and other developer tools (”API”, “dev tools”).
These Terms govern your usage of the Services. By utilizing the Services, you accept and agree to abide by our Terms. If you disagree with or are unable to abide by these Terms in any way, you must not use the Services.
Our privacy policy can be found here, and describes how we collect, use, and store your personal information while you use the Services. By using the Services, you consent to the terms set forth in the privacy policy with regards to your personal information.
You agree to not use the Services in any way that (i) violates any law or regulation, (ii) is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable, (iii) jeopardizes the security of the Services or any computers or networks utilizing the Services, (iv) decompile, reverse engineer, or disassemble the software, except and only to the extent that the applicable law permits.
Misusing the Services in any of manners listed above will result in the immediate termination of your right to access or use the Services.
Your access and use of our Services is at your own risk. The Services are provided on an “AS-IS” and “AS AVAILABLE” basis.
PAIRLY DISCLAIMS ALL WARRANTIES AND CONDITIONS (EXPRESS OR IMPLIED) OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Pairly makes no warranty and disclaims all responsibility and liability for (i) whether our Services will meet your requirements, (ii) whether our Services will be available on an uninterrupted, timely, secure, or error-free basis, (iii) the completeness, accuracy, availability, timeliness, security, or accuracy of any content contained in the Services, (iv) any failures or delay in credit transactions.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PAIRLY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES.
Pairly reserves the right to revise the Terms at any time, and by using the Services after the Terms are revised, you agree to the most updated version of the Terms. Users will be notified when the Terms change via notification on the Pairly platform or via the email address associated with their account.
